These Terms and Conditions govern use of the EdiWay website, platform, dashboards, resources, home education tools, school-store features, messaging tools, careers services, and related services.

By using our website or services, you agree to these Terms and Conditions. If you do not agree, you must not use the relevant service.
These terms apply to the use of:
Users must create or use only accounts they are authorised to use. Some parts of the platform are available only through school, parent, or professional invitations, or through approved registration routes.
You are responsible for keeping your login details secure and for activity carried out through your account, unless the activity results from our failure to maintain reasonable security.
The platform uses role-based access. Access may depend on user type, linked school, linked child, invitation status, permissions, subscription status, or add-on entitlement.
We may restrict, suspend, or remove access where necessary for security, safeguarding, contractual, operational, or legal reasons.
Schools, parents, carers, and invited professionals are responsible for ensuring that the information they add, upload, or share is lawful, accurate where reasonably possible, and appropriate for the purpose for which it is used.
Users must only invite others where they have the authority to do so and must not share sensitive learner data outside authorised platform workflows.
EdiWay supports school-enrolled, home-educated, and hybrid learner journeys. Historical records, home education records, and school records may be preserved, displayed, shared, or transitioned according to platform permissions, school settings, and applicable legal or safeguarding requirements.
You must not:
Users may submit content, including records, files, messages, notes, assessments, resources, and evidence uploads. You retain responsibility for the content you upload or submit. You confirm that you have the right to submit it and that doing so does not infringe the rights of others or break the law.
You grant us the rights reasonably necessary to host, process, secure, back up, display, and manage that content in connection with the service.
Some parts of the service may include AI-supported tools. AI outputs are provided to assist users and must be reviewed by an appropriate person before reliance is placed on them.
AI outputs do not replace professional judgment, school decision-making, medical advice, safeguarding decisions, or legal advice.
Some services may require payment, subscription, add-on purchase, or school-level activation. Access to certain features may depend on successful payment, linked school setup, or active entitlement.
Where payments are processed through third parties, such as Stripe, those providers may apply their own terms.
Where school-store or marketplace features are active, additional store, payment, refund, and fulfilment rules may apply. Those rules should be read together with these Terms and our Refunds, Returns and Cancellations Policy.
Unless otherwise stated, the EdiWay platform, branding, code, and original service materials remain our property or the property of our licensors. These terms do not transfer ownership of the platform itself.
User-generated educational, school, or family content remains subject to the rights of the relevant user or organisation, except for the service-use rights described above.
We may update, improve, restrict, suspend, or discontinue parts of the service from time to time. We do not guarantee uninterrupted availability. Planned or emergency maintenance, security issues, third-party outages, or legal obligations may affect access.
We may take steps to restrict access, preserve records, or cooperate with lawful requests where safeguarding, child safety, platform abuse, or serious misuse concerns arise.
Nothing in these terms excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to that, EdiWay provides the service on an “as available” basis and does not accept liability for indirect or consequential loss, business interruption, loss of opportunity, or reliance on user-generated or AI-generated content without appropriate review.
We may suspend or terminate access where necessary for security, safeguarding, misuse, breach of contract, legal obligations, or non-payment, subject to any separate school or customer agreement that applies.
Use of personal data through the service is governed by our Privacy Policy and related notices.
These terms are governed by the laws of England and Wales.
